OHS Reviews and Recommendations
In 2002, Alberta's Occupational Health and Safety Act was amended and the changes that were introduced paved the way for the publication of a new Occupational Health and Safety Regulation and also provided the Minister of Employment and Immigration with the authority to adopt and enforce and Occupational Health and Safety (OHS) Code. The Act also increased the financial penalties to better reflect the seriousness of offenses, as well as providing the Courts with additional powers and a degree of flexibility to deal with OHS violators. For example, this may include, but is not limited to, the establishment of an effective and current health and safety program or specific safety training or education for workplace employees.
The Alberta Occupational Health and Safety Code initially came into force on April 30, 2004 and is administered and enforced by Alberta's Workplace Health and Safety (WHS) division. The Code sets out the mandatory technical standards and workplace safety rules that both employers and workers must comply with at workplaces under the inspection jurisdiction of the WHS division. However, the responsibility for overseeing the making of the Code is held by the OHS Safety Council who make recommendations based on consultations with the public and relevant stakeholders.
